Is There Such Thing as a Victimless Crime?
I pick this topic, because I was thinking of how some victimless crimes such as piracy, gambling and illicit drug use can be seen as victimless or why are they victimless if in a certain way they are consensual and they have a negative indirect impact on the people committing this actions or on the people surrounding them or simply in the way in which this crimes in a large scale tend to be harmful to the economy and the society in many different aspects.
By definition, a victimless crime is considered to be an action that is ruled illegal, but it does not violate or threatens the integrity, rights of any individual. A victimless crime is usually consensual, it is agreed upon before the action is committed, and a victimless crime usually a response to the bad imposition of a law or just a way to get around the law to gain something.
Some examples of victimless crimes (and why do I think they are not victimless) are:
- Gambling: Is the wagering of material value on an event with an uncertain outcome. But in gambling, there is not harming physically any person, and there is no one forcing the person to gamble, but in a certain way it damages the economy of the gambler, and in a psychological level he might be developing a gambling addiction which could have a very bad negative outcome in his person and in the people who surround him.
- Piracy: Is defined as the unauthorized use of copyrighted or patented material. In practice, piracy is not harming anyone whether it is physically or psychologically, it might even help people with low acquisitive power to enjoy some entertainment which otherwise they would not be able to enjoy. But piracy harms the economy because piracy doesn’t pay taxes, and it hurts the integrity of the third person who patented the pirated item as well as the integrity of the product, at the end it indirectly hurts many different industries.
- Illicit drug use: It is simply when someone consumes an illegal substance. In this case the negative impact of the subject using the illegal substance is obvious, it is harming his body and its mind, is completely nocive to the human health, and while being in the influence of such substance this can lead to actions that can damage third parties, such as car accidents or any kind of accident.
I think that with these examples I could really illustrate my position regarding victimless crimes and I could also illustrate what a victimless crime is. Also in a victimless crime a subject in matter is that is very difficult to define a victim of a victimless crime, even though there are some victims. Defining a victim of a victimless crime is a very controversial topic given to the fact that in many cases the guy committing the crime is the victim or the more damage victim of the crime.
To conclude I think victimless crimes, are always consensual and there is always a victim,
