RESUMEN:

En éste trabajo de investigación nos propusimos indagar sobre la hipótesis concreta respecto a si existe maltrato físico, psicológico y emocional en el ámbito familiar de los adultos y adultas mayores. El método de investigación utilizado fue un estudio tanto cualitativo como cuantitativo que, a través de diferentes fuentes periodísticas, Jurisprudencia, Doctrina, Leyes Nacionales e Internacionales, y el trabajo de campo realizado en el Departamento de Práctica Profesional,^[1] nos permitió obtener como resultados datos y estadísticas que dan evidencia clara y concreta del gran número de personas mayores que sufren maltrato familiar.

Consideramos que el maltrato de los ancianos es un grave problema de salud pública y social  por lo cual, es necesario visibilizar esta realidad que sufren miles de personas y concientizar a la sociedad para comenzar a dar respuestas claras y de esta manera terminar con la vulneración de los derechos de los adultos mayores. Por lo expuesto, y por considerar necesario y de carácter urgente, hemos presentado una Propuesta de Proyecto puntual y específica, a los fines de proteger la integridad física, psicológica y emocional de los Adultos Mayores.

Por todo lo expuesto, hemos concluido que existe maltrato hacia el adulto mayor dentro del ámbito familiar, que es un maltrato que se manifiesta de diferentes maneras, y a través de diversos comportamientos de quienes son su entorno más íntimo. A pesar de toda normativa vigente, tanto nacional e internacional, no se ha logrado en la actualidad disminuir los casos de maltratos cotidianos a los que se enfrentan las personas mayores en su entorno familiar, el cual debería ser de acompañamiento y contención. En base a que esta violencia se centra en el núcleo familiar se agrava la posibilidad de que las personas vulneradas puedan denunciar y acceder a la justicia. Es necesario que el Estado implemente políticas públicas de cumplimiento efectivo, como también, un derecho procesal exclusivo y expedito para evitar las trabas judiciales que no permiten dar una rápida y efectiva solución para cada caso de maltrato hacia los adultos mayores.

        ABSTRACT:

In this research work we set out to investigate the specific hypothesis regarding whether there is physical, psychological and emotional abuse in the family environment of adults and older adults. The research method used was a qualitative and quantitative study that, through different journalistic sources, Jurisprudence, Doctrine, National and International Law, and the field work carried out in the Professional Practice Department, allowed us to obtain data and results statistics that give clear and concrete evidence of the large number of elderly people who suffer family abuse.

We consider that the mistreatment of the elderly is a serious problem of public and social health for which, it is necessary to make visible this reality that thousands of people suffer and raise awareness in society to begin to give clear answers and thus end the violation of the rights of the elderly. For the foregoing, and as it is considered necessary and urgent, we have submitted a specific and specific Project Proposal, in order to protect the physical, psychological and emotional integrity of the Elderly.

For all the above, we have concluded that there is abuse towards the elderly within the family, which is abuse that manifests itself in different ways, and through various behaviors of those who are their most intimate environment. Despite all current regulations, both national and international, it has not been possible to reduce the cases of daily abuse that elderly people face in their family environment, which should be accompanied and contained. Based on the fact that this violence focuses on the family nucleus, the possibility that injured persons can denounce and access justice is aggravated. It is necessary for the State to implement public policies of effective compliance, as well as an exclusive and expeditious procedural right to avoid legal obstacles that do not allow a quick and effective solution for each case of abuse towards the elderly.
