APLICACIÓN DE LA TERMINACIÓN ANTICIPADA EN EL DISTRITO JUDICIAL DE AYACUCHO 2017.

Resumen

Objetivo: Identificar el nivel de aplicación del proceso especial de terminación anticipada en el Distrito Judicial de Ayacucho.

Material y métodos: Tipo de investigación jurídica aplicada, explicativa causal, método de estudio no experimental, diseño transeccional explicativa o causal. La muestra estuvo constituida por el 100% de procesos de terminación anticipada tramitados en el Distrito Judicial de Ayacucho durante el año 2017, que en este caso fueron 92 procesos judiciales que podrían aplicarse la terminación anticipada.

Resultados: El 87.5% (7) de jueces no aplicaron la figura de la terminación anticipada en estos meses de estudio por diversas razones y tan sólo el 12.5% (1) si aplicaron dicha figura legal. El 51.1% (45) de abogados litigantes manifestaron no haber solicitado la terminación anticipada y el 48.9% (43) si solicitaron la terminación anticipada. La edad y el sexo no son factores implicados en el nivel de conocimiento del proceso de terminación anticipada (P>005) y el tiempo de ejercicio profesional si está implicado en el proceso de terminación anticipada (P>0.05).

Conclusiones: Existen delitos en las cuales fueron solicitados la figura jurídica de terminación anticipada en el distrito judicial de Ayacucho.

APPLICATION OF THE COMPLETION EARLY IN THE JUDICIAL DISTRICT OF AYACUCHO 2017.

Abstract

Objective: To identify the level of implementation of the special process of completion anticipated in the Judicial District of Ayacucho.

Material and methods: type of legal applied, explanatory causal research, method of non-experimental study, explanatory or causal transactional design. The sample consisted of 100% of early termination processes transacted in the Judicial District of Ayacucho during the year 2017, which in this case were 92 prosecutions that could apply the early termination.

Results: 87.5% (7) of judges not applied the figure of completion anticipated in these months of study for different reasons and only 12.5% (1) if they applied such a legal figure. The 51.1% (45) of trial lawyers said not having requested the early termination and 48.9% (43) if they requested the early termination. Age and sex are factors involved in the level of knowledge of the process of early termination (P > 0.05) and time of practice if it is involved in the process of early termination (P < 0.05).
